The Duty of Technology Competence CLE

Technology is intertwined with modern life, from smartphones to e-filing. Courts and clients alike expect attorneys to be technologically literate. As one Delaware court held, “Professed technological incompetence is not an excuse for discovery misconduct.” James v. Nat’l Fin. LLC, No. CV 8931-VCL, 2014 WL 6845560 (Del. Ch. Dec. 5, 2014). We will look at the ethical duty of competence and confidentiality through Ohio and ABA Model Rules of Professional Conduct 1.1 & 1.6, and explore how they apply to a lawyer’s knowledge and use of technology.
