For the first class read, and be prepared to discuss, pp. 1, 18-26 in the Dukeminier, Krier, Alexander, Schill &Strahilevitz case book. 

Pay particular attention to the notes that follow the case of Pierson v. Post.  See if you can answer the questions that the authors raise in the notes.
