“Administrative Law: Past, Present, and Future” 

2021 Sullivan Lecturer, Donald F. McGahn II, Former White House Counsel

Administrative law is at the center of current public law and policy debates.  Historically, Presidential transitions have prompted shifting positions—sometimes, radically—on the Executive Branch and the scope of its powers.  Many members of the U.S. Supreme Court, including some of its newest members, have questioned longstanding administrative law doctrines.  And, in the legal academy and across the judiciary, the emergence of originalism has yielded serious debates over the separation-of-powers concerns implicated by administrative law. 

In this lecture, former White House Counsel Don McGahn will survey the themes and developments that have defined administrative law in recent decades.  He will also forecast questions that may be answered—and areas where changes may be most pronounced—in coming years.
