The Duty of Technology Competence CLE

Friday, April 23, 2021

12:00 pm - 1:00 pm

Technology is intertwined with modern life, from smartphones to e-filing. Courts and clients alike expect attorneys to be technologically literate. As one Delaware court held, “Professed technological incompetence is not an excuse for discovery misconduct.” James v. Nat’l Fin. LLC, No. CV 8931-VCL, 2014 WL 6845560 (Del. Ch. Dec. 5, 2014). We will look at the ethical duty of competence and confidentiality through Ohio and ABA Model Rules of Professional Conduct 1.1 & 1.6, and explore how they apply to a lawyer’s knowledge and use of technology.

Presented by Jennifer L. Wondracek, Director of the Law Library & Professor of Legal Research and Writing, Capital University Law School.

This course has been approved by the Supreme Court of Ohio Commission on Continuing Legal Education for 1.00 total CLE hours of attorney professional conduct instruction.
